Deputyship
If a person becomes mentally incapable but does not have a LPA or an EPA then someone must be appointed by the Office of the Public Guardian to manage their affairs - a Deputy. This person’s activities are strictly regulated by the Court and permissions are necessary for major decisions. Accounts need to be filed at the Court every year and fees paid. There is a significant administrative burden and bureaucracy and this why LPAs and EPAs were introduced. It is better to avoid the expense and inconvenience of a Deputy which might end up costing many thousands in court fees by making an LPA.
